Another Federal Court Win for Duke Evett!

Keely Duke and Duke Evett recently won a Motion to Dismiss on behalf of their client who is a Private Investigator.  The Plaintiff made numerous baseless claims against the State of Idaho, multiple state representatives, prosecuting attorneys, the Idaho State Police, and our client (an investigator) related to the underlying case.  In the underlying case, the Plaintiff alleged that his 2007 conviction for possession of 75 pounds of marijuana should be vacated and made multiple claims of “fraud against the court.” The U.S. District Judge for Idaho dismissed the claims against our clients, finding that the Plaintiff’s claims were barred by multiple doctrines, including the Rocker-Felder Doctrine, the Heck v. Humphrey Doctrine, and Res Judicata.
