Duke Evett Court Victory!

Great news!  Josh Evett just won a motion for partial summary judgment on behalf of a governmental entity in Idaho state court, successfully arguing that the court should dismiss plaintiff’s 42 USC § 1983 federal civil rights claims.  This is an important victory as it significantly weakens plaintiff’s damages case, simplifies the case for trial, and opens the door to other motions.  The motion involved the doctrine of qualified immunity and application of the deliberate indifference standard.  Congrats, Josh!
