Duke Evett wins Motion for Summary Judgment in medical malpractice action!

Keely Duke and Marissa Brakes prevailed on a Motion for Summary Judgment involving a claim for medical malpractice, where they argued that Plaintiff’ standard of care expert did not meet the statutory foundational requirements of Idaho Code §§ 6-1012 and 6-1013. The District Court agreed that Plaintiff’s expert witness testimony was inadmissible, and dismissed Plaintiff’s action, with prejudice. Case dismissed!
